相当于到提交485时，我一直都是h4 pending，自己没意识到律师也没有提醒
23年3月 队友爆绿，我收到combo卡，直到最近才收到20年初第一份539 denial。理由是h1b已经transfer，不符合h4的申请条件。
这样的后果就是我有一整年的oos。律师说只能境外走cp程序，因为第一份539被拒，后面的extension被拒都是时间问题，unqualify 485
我个人认为你H4pending的时候交485没有任何问题。你仔细读一下USCIS据你H4申请的信，看说了些什么, 如有必要你是可以appeal USCIS的的决定.

你应该找其他律师咨询一下，寻求second or third opinion。个人感觉你这个律师不靠谱.

我的理解是你不可能有一整年的oos. 我们当时遇到类似的情况，第一份H4 pending (COS)的时候，H1 transfer, 我们又提交H4 extension.  过了2个月, H1 和 H4 同时被批准(第一份H4 still pending).
在我们提交第一份H4 RFE回复的时候，我们已经提交了485（这是我们已经没有H1/4 visa， 只有485 pending).  又过了几个月，我们收到第一份H4 的据信, 理由是我们现在已经没有非移民签证的status, USCIS 没法批准这个COS (change of status).  USCIS在信中特别强调，这个否决并不影响我们现在的状态(485 pending).  也就是说， 第一份H4的否决并没有导致第二个H4 (extension)以及其后485提交失效.
我这个比较尴尬的是，队友已经爆绿了，没有h1b了，我的H4 extension也还没有批，我现在还是pending状态

你提交485的时候身份没有任何问题。我前面提到过，我们的H4被否决的时候也没有H1/4身份，只是485 pending。

你不放心的话，可找其他律师咨询一下，或者你到AVVO发帖问一下。 我的理解是你现在的485不会受到H4否决的影响，这个485仍然有效。
